Understanding how to comply with the Patient Protection and Affordable Care Act of 2010 (PPACA) (Pub. L. No. 111-148) is now a top priority for most employers.
The U.S. Department of Health and Human Services (HHS) is expected to issue implementing regulations on the new law in the Federal Register possibly early next week.
Employers must comply within six months of the law’s enactment on March 23, 2010 (September 23) with provisions that prohibit lifetime annual limits on insurance coverage, rescissions of coverage except in cases of fraud or misrepresentation, and excessive waiting periods, among others. Waiting periods for health plan coverage will be limited to no more than 90 days.
SHRM will review and analyze any health care rules once issued, and will provide advice to our members. Additionally, we will make recommendations for changes or additions to these regulations during the expected public comment period.
