ADEA Update

SHRM Files Amicus Brief in Age Discrimination Case
On March 4, 2009, SHRM filed an amicus brief in the U.S. Supreme Court in the case of Gross v. FBL Financial Services, Inc., in support of the employer.  The question before the Court is whether a plaintiff alleging discrimination under the Age Discrimination in Employment Act (ADEA) must present “direct evidence” of the discrimination in order to shift the burden of proof to the employer. [ More ]
