The American Recovery and Reinvestment Act imposed new HIPAA privacy and security rules for employers and their health plans, further complicating employers' compliance with this law. The new rules now require health plans (and employers on behalf of their health plans) to report breaches and take additional steps to ensure the security of certain employee health information.
In addition, the new rules more than doubled the potential penalties for HIPAA failures. This program will provide an overview of all the relevant provisions of HIPAA privacy and security, with a particular emphasis on steps employers must take to comply with the new rules.
About the Presenter
John Barlament is a partner in the law firm Quarles & Brady LLP, practicing exclusively in employee benefits law. He represents employers, third party administrators, brokers and benefit consultants in all aspects of employee benefits law. Mr. Barlament has extensive experience in a broad range of employee benefit issues, including HIPAA, ERISA and COBRA. He is recognized as a national speaker on a wide range of benefits issues and is a contributing author on two of the country’s leading manuals in these areas (EBIA’s Consumer-Driven Health Care and EBIA’s HIPAA Portability, Privacy & Security).
