Illinois Extends Bereavement Leave Rights in Two Laws (1/1/24)




Amendments to the Victims' Economic Security and Safety Act

On July 28, 2023, Governor J.B. Pritzker signed House Bill 2493, which takes effect on January 1, 2024, and amends the Victims' Economic Security and Safety Act (VESSA). VESSA entitles employees who are victims of domestic violence, sexual violence, or gender violence (or whose family members or household members are victims of such violence) to take unpaid leave from work to address issues related to the violence.

The new law also explains that an employee can meet the certification requirement for taking leave by submitting (in addition to a sworn statement) documents in their possession showing that a victim was killed by a crime of violence, such as a death certificate or published obituary.

An employee who takes leave for one of the three new, amended purposes listed above related to death involving crimes of violence is entitled to a total of two workweeks of unpaid leave (10 workdays), which must be completed within 60 days after the employee receives notice of the death of the victim. However, the employee may still be entitled to additional protected time off under VESSA during the same 12-month period for other qualifying reasons.

Child Extended Bereavement Leave Act

Illinois passed a new law that will extend the amount of unpaid leave that employees are entitled to for certain categories of child bereavement. The Child Extended Bereavement Leave Act (CEBLA), which was signed into law by Governor J.B. Pritzker on August 4, 2023 and will take effect on January 1, 2024, will require covered Illinois employers with 50 or more employees to allow additional amounts of unpaid leave to employees who suffer the loss of a child due to homicide or suicide.
