The Brave New World of I-9 and E-Verify Compliance

During the past few months, employers across the U.S. have witnessed a significant change in both Form I-9 and E-Verify enforcement, due in large part to the continuing debate on immigration and border security. Following the 2017 signing of President Trump’s “Buy American and Hire American” Executive Order, federal and state agencies across the country have implemented new policies and initiatives that drastically impact employers’ Form I-9 and E-Verify processes this year and beyond.

For HR and compliance managers, this is not particularly welcome news. The Form I-9 is already known as the most perplexing U.S. employment form, with an intricate array of rules, competing objectives and unforgiving timelines. Under the Trump administration’s new initiatives, employers should expect even greater scrutiny of Form I-9 records and policies from Immigration and Customs Enforcement (ICE) as well as increasing accountability for HR managers and compliance officers.

In this program, John Fay, LawLogix’s vice president and general counsel, and Katie Minervino, partner at Pierce Atwood, will discuss how employers can assess their hiring policies and procedures to ensure compliance with rapidly changing enforcement directives. They will discuss:

Learn about our speaker About the Presenters: John Fay is vice president and general counsel at LawLogix. He is a business immigration attorney and technologist with a deep applied knowledge of business immigration, I-9 compliance and E-Verify rules and procedures. During his career, Fay has advised corporations, educational institutions, and individuals on a variety of U.S. immigration and I-9 issues. At the same time, he has also been uniquely involved in information technology, having designed several immigration and I-9 management software applications. Fay is a frequent speaker on I-9 and E-Verify compliance topics, presenting at various employment and immigration conferences throughout the U.S. He is also a prolific writer on I-9 and E-Verify compliance and is responsible for establishing the LawLogix Compliance Blog and Knowledge Base, which features hundreds of original articles and guides on how to properly complete the I-9 and E-Verify process.

Katie Nokes Minervino is a partner at the law firm Pierce Atwood, where she has been practicing employment-based immigration law for the past 10 years. She helps employers and employees create and execute immigration strategies to meet their short- and long-term immigration needs, as well as advising on employment verification compliance issues. Minvervino is the current vice chair of the American Immigration Lawyers Association Verification & Documentation Liaison Committee.
