California Overtime Pay and Hours and Days of Work Policy




Purpose/Objective

[Company Name] complies with applicable laws regarding the payment of overtime wages.

Eligibility

All nonexempt employees who work more than eight hours in a workday or more than 40 hours in a workweek. The company’s hours of operations are [Monday through Friday] from [8:00 a.m. to 6:00 p.m.]. The company’s workweek starts on [Monday at 12:01 a.m. and runs through Sunday at 12:00 midnight], and the company’s workday starts at [12:01 a.m. and runs through midnight].

Procedures

Nonexempt employees are required to accurately record their work time, including start and stop times, and meal periods during each workday. Additionally, employees are required to obtain advance approval from [their supervisors/other job title] before working overtime or hours beyond the regular work schedule.

Nonexempt employees who do not work an alternative workweek schedule are eligible for overtime wages as follows:

  • One and one-half times an employee’s regular rate of pay for any work:
    • Between eight and 12 hours in one workday.
    • In excess of 40 hours in a workweek.
    • During the first eight hours on the seventh consecutive day worked in a workweek.
  • Twice an employee’s regular rate of pay for any work:
    • In excess of 12 hours in one workday.
    • In excess of eight hours on the seventh day worked in a workweek.

Nonexempt employees who work an alternative workweek schedule are eligible for overtime wages as follows:

  • One and one-half times an employee’s regular rate of pay for any work:
    • In excess of the schedule established by the alternative workweek arrangement up to 12 hours in a workday.
    • In excess of 40 hours in a workweek.
    • In excess of eight hours in a workday, if the company requires the employee to work fewer hours than those that are regularly scheduled by the alternative workweek arrangement.
  • Twice an employee’s regular rate of pay for any work:
    • In excess of 12 hours in one workday.
    • In excess of eight hours on those days worked beyond the regularly scheduled number of workdays established by the alternative workweek arrangement.
