AI Policy, Worker Protections Take Center Stage in Hearing

The House Subcommittee on Workforce Protections convened a hearing titled “Building an AI-Ready America: Understanding AI’s Economic Impact on Workers and Employers,” bringing together policymakers, legal experts, labor advocates, and HR leaders to examine how artificial intelligence is reshaping the workplace.  

This hearing is the latest in a series of Congressional explorations of the impact AI has on different industries and how their leaders can prepare and support workers navigating these changes.  

For HR professionals, the discussion underscored a familiar tension: AI’s potential to drive efficiency and workforce transformation versus the risks it poses to worker privacy, compliance, and job stability. 

AI as a Workforce Transformation Tool 

Chatrane Birbal, representing the CHRO Association, emphasized that leading organizations are already embedding AI into core HR and business processes as an augmentation tool, not as a replacement for workers. 

“The best use of AI is to augment human judgment, not replace it,” she told lawmakers.  

Birbal outlined how employers are using AI to automate repetitive tasks, improve safety monitoring, and enhance decision-making in areas like healthcare. She also stressed that organizations adopting AI successfully are treating it as a broader workforce transformation effort, requiring training, communication, and employee engagement. 

For HR leaders, this reinforces how AI adoption is a change management challenge that sits squarely within HR’s domain.

Compliance and Operational Gains

Matthew Gizzo of the labor and employment law firm Ogletree Deakins highlighted AI’s potential to significantly improve wage and hour compliance — an area that has long posed challenges for employers. 

“AI offers employers powerful tools to meet their wage and hour obligations more accurately, more efficiently and more consistently than ever before,” he said.

From automated time tracking to real-time compliance monitoring and payroll calculations, AI tools can reduce errors and legal exposure. Gizzo also noted that these benefits extend to employees, increasing the likelihood that workers receive proper compensation.

However, he cautioned that overly complex or fragmented regulations — particularly at the state and local level — could discourage adoption and limit these benefits.

Worker Risks and Rising Concerns

In contrast, Sara Steffens of the non-profit We Build Progress raised concerns about how AI is being used to monitor and manage workers, often with limited transparency or safeguards.

“AI-powered surveillance makes it harder for workers to find private spaces to organize or to share safety and wage concerns,” she said, pointing to widespread use of tracking tools, biometric data collection, and AI-driven performance monitoring. She warned that these technologies can increase stress, enable discrimination, and weaken labor protections.

Steffens emphasized that while AI introduces new tools, existing labor violations — such as wage theft or union suppression — remain illegal, even if harder to detect.

Policy, Data, and the Pace of Change

Rachel Greszler of the non-profit Advancing American Freedom focused on the policy challenge of keeping pace with AI’s rapid evolution.

“We still lack data on where it’s being used, what tasks it’s affecting, how it’s changing hiring and productivity,” she noted.

She recommended expanding federal data collection efforts to better understand how AI is transforming specific job tasks rather than entire roles — an approach that could help employers, workers, and policymakers make more informed decisions.

Greszler also warned against overregulation, arguing that the greater risk may be stifling innovation or falling behind global competitors.

What HR Leaders Should Take Away

While the hearing reflected differing viewpoints, several themes emerged that are directly relevant for HR:

1. AI adoption is already happening at scale. Organizations are integrating AI into workflows, compliance systems, and talent processes today.

2. Change management is critical. Successful AI implementation depends on training, transparency, and employee engagement — areas where HR plays a central role.

3. Compliance may improve, but complexity remains. AI can strengthen wage and hour compliance, but regulatory fragmentation could create new challenges.

4. Worker trust is at risk. Surveillance, data use, and transparency concerns highlight the need for clear policies and ethical guardrails.

5. Skills and job design will continue to evolve. As Greszler noted, AI is more likely to reshape tasks than eliminate jobs entirely, placing a premium on reskilling and workforce planning.

Ultimately, the hearing made clear that HR’s mandate is to help organizations harness AI’s benefits while ensuring it is deployed responsibly, transparently, and in ways that build employee trust.
