Compliance with the New York Worker Adjustment and Retraining Notification (NY WARN) Act just got harder (again). On June 21, 2023, the New York Department of Labor's amendments to the NY WARN regulations took effect and some of the changes are sweeping.
Under the amended regulations, the definition of a covered employer is expanded to count not just employees at a single site of employment in the state, but also employees who work remotely but are "based at the employment site."

In the event of a sale of a business, the Act requires the seller to notify employees of any event triggering the Act before and including the date of the sale. The buyer is required to notify employees of any triggering event after the date of the sale. The new regulations add that if the transfer of the seller's employees is a "good faith condition of the purchase agreement" and if the buyer declines to employ the seller's employees, the buyer is obligated to provide notice and the seller is relieved of this obligation.

The statute enumerates certain exceptions to the requirement of providing 90 days' notice of a mass layoff or plant closure. Under the amended regulations, to rely on one of these exceptions, an employer must receive a determination from the Commissioner that the employer has met all the elements of the exception.
