Program Overview

As with every new year, California employers may face an abundance of new laws that will regulate the workplace in 2024. Hear from four high-caliber California employment law attorneys on the latest laws that will impact your organization. Find out what bills Governor Newsom approved for the coming year.

Many of the proposed laws will be enacted on January 1, 2024. Join us to become familiar with these proposed laws and more to ensure you are ready for compliance. Find out how to best prepare your organization and stay compliant, including proper documentation, securing relevant evidence, and communication to various stakeholders.

Session 1 – Complying with Employee CCPA Requests: Best Practices and Strategies for Overcoming Common Roadblocks
Speaker: Anthony Isola, Fisher Phillips

Join us for this engaging session on how to comply with employee requests under the CCPA.As of 2023, California employees can make the following types of requests on a business: Request to know, Request to access, Request to delete, Request to correct, Request to opt out of sale and sharing, Request to limit use of sensitive personal information. There are a many reasons why HR professionals would want to attend this presentation, but here are the top three reasons: (1) the CCPA is still new and many HR professionals still do not know how to comply with these types of employee requests; (2) when a business receives one of these types of requests, the business will look to the HR team to know the business’s obligations and have a solution; and (3) the California Attorney General recently announced an investigative sweep of employers in California focusing on employer CCPA compliance regarding employee data.

California continues to offer employees with new leave protections that employers must learn about and follow.  Leave laws apply whether an employee is reporting to work at the employer’s headquarters, the employee’s home office or somewhere in between.  Refresh on the old and learn about the new and how to apply and manage these protections no matter where your employees work.

What Employers Need to Know About Workplace Violence Prevention Plans, Non-Compete Agreements, and the Fair Chance Act

In this session, we will focus on three topics affecting almost all California employers.  First, we will discuss a new law requiring employers to maintain written workplace violence prevention plans.  We will also discuss the required components of, and exemptions from, those plans.  Second, we will discuss recent changes to California’s non-compete law, including a new private right of action employees may bring against employers that attempt to enforce non-compete agreements.  Finally, we will discuss an update to the Fair Chance Act, which prohibits employers from asking applicants about their conviction histories.  As to each topic, we will focus heavily on how employers can mitigate existing risk.

Anthony Isola is an attorney that helps employers with legal issues affecting the workplace, including matters concerning the rapidly evolving subject of employee privacy. In particular, he assists employers with compliance with a variety of privacy laws, including the California Consumer Privacy Act. When providing guidance to clients related to legal issues concerning electronic employment data, Anthony draws on his prior professional experience as a software engineer. He also frequently presents and authors articles on topics related to data privacy.

California Lawyers Association

Erika Frank is the Associate Executive Director, General Counsel and Section Chief for the California Lawyers Association. As a member of CLA’s Senior Executive Team, Erika oversees 18 sections and their managers, including Human Resources. Her position on the Senior Executive Team ensures that the vision and mission of CLA’s Board of Directors achieve an expanded reach to support the growing membership and future impact.

Over her twenty-year career, Erika has utilized her legal expertise in employment and labor law to benefit the non-profit and private sector alike. When serving as Counsel at the Shaw Law Group in Sacramento, California, Erika advised the region’s employers about California’s complex employment laws, conducted impartial workplace investigations for public and private sector employers, and conducted seminars and training programs.

Erika also served General Counsel and Executive Vice President of Legal Affairs at the California Chamber of Commerce, the largest broad-based trade association in California. During her tenure at the Chamber, Erika developed an expertise in employment law compliance, oversaw CalChamber’s Labor Law Helpline and assisted countless members with their employment law questions. She also played an integral role in the launch and success of CalChamber’s “The Workplace” podcast.

Erika has not only produced but has led numerous seminars and webinars on employment law topics such as leaves of absence, wage and hour compliance, harassment, discrimination, and retaliation prevention. She is known for her relentless energy and ability to transform legal concepts into simple stories and realistic scenarios for any type of audience and professional. 

In any organization that she is a part of, Erika utilizes her skills to translate vision into reality. Paying special attention to organizational culture, structure, and human capital, Erika is able to maximize potential and achieve results that boards, stakeholders and members are proud of. She holds a Bachelor’s Degree of Arts in Political Science from the University of California, Santa Barbara, and received her Juris Doctorate Degree from University of the Pacific, McGeorge School of Law. In her spare time, Erika enjoys spending time with her family, running the local trails, swimming laps in the pool, listening to the trending legal podcasts, and practicing mindfulness.

Jessica Shafer has a wide-ranging practice representing private, public, and nonprofit entities in all aspects of labor and employment law, including claims of discrimination and harassment, wage and hour compliance, and day-to-day employment matters.  Jessica also creates and provides workplace training programs to California employers on sexual harassment, workplace violence, corrective action and discipline, workplace investigations, and avoiding wrongful termination claims.  She is dedicated to leading employers to the right workplace outcome through training, private counsel, or litigation. 

Jessica understands that California’s ever-changing legislative landscape is as impactful on employers as long-established precedent.  As a result, she regularly reviews and presents on state legislative and regulatory developments in labor and employment law, as well as municipal ordinances and regulation of the workplace.  Jessica delights in assisting the employer community in understanding and complying with new and upcoming legal mandates.

An engaging speaker, Eric conducts seminars across the state to assist employers in navigating California’s rigorous, ever-evolving compliance regulations, always with an emphasis on preventing litigation. He’s a published contributing author for Forbes and he co-authored MS&A’s e-book, “Navigating COVID-19: A Legal Guide for California Employers.” It’s a free resource for businesses in our state, regularly updated to reflect the changing pandemic landscape. Eric is also an employment law expert consultant for Insurance Education Association (IEA) an organization dedicated to providing HR, risk managers and insurance carriers education on disability management and other employment-related compliance mandates. He advises on and is an editor for IEAs course materials and is a frequent guest lecturer. Eric is proficient in written and spoken Spanish.
