2026 Midterms: State Ballot Measures That Could Affect the Workplace

October 29, 2026 | Rachel Zheliabovskii

As voters head to the polls for the Nov. 3 midterm elections, several states will ask residents to weigh in on proposals that could have implications for employers and employees. From collective bargaining rights and employment discrimination protections to healthcare funding and restrictions as well as rights, the outcomes could influence how organizations manage their workforces and navigate legal compliance.

While some measures would directly affect employment-related laws, others could have more indirect consequences for employee benefits, industry-specific staffing, and workplace policies. Here are some state ballot initiatives HR professionals should keep an eye on this election season.

1. Idaho: Restricting Future Marijuana Legalization Initiatives

Idaho’s HJR 4 would amend the state constitution to give the legislature exclusive authority to legalize marijuana, narcotics, and other psychoactive substances, removing voters’ ability to legalize them through citizen-initiated statutes.

The proposal concerns who possesses the authority to change the state’s controlled-substance laws, rather than immediately legalizing or prohibiting a new workplace practice.

What it means for HR: The amendment would not directly change employer drug-testing requirements. However, it could influence how future changes to marijuana regulation occur, making it relevant to organizations monitoring evolving substance-use and workplace safety laws.

2. Maryland: Funding State Employee Labor Agreements

Maryland’s Question 1, the Arbitration Reform for State Employees Act of 2026, would amend the state constitution to require the governor to include funding for collective bargaining agreements in the proposed state budget.

The requirement would cover negotiated employment terms, including wages, hours, fringe benefits, and health benefits, regardless of whether the agreement was reached through negotiations or a neutral decision-maker’s order.

What it means for HR: The measure could make the budgeting process more closely reflect negotiated employment commitments. Public-sector HR and labor relations professionals would need to understand how the change affects contract negotiations, compensation planning, and implementation of bargaining agreements.

3. Massachusetts: Allowing Public Defenders to Unionize

Massachusetts Question 2 would give employees of the Committee for Public Counsel Services (CPCS), the state’s public defender agency, the express right to engage in collective bargaining.

If approved, employees could form a union and negotiate employment terms with their employer. The agency would also be required to request funding from the governor to implement any resulting collective bargaining agreement.

What it means for HR: Although the proposal is limited to a particular public-sector workforce, it could create new labor relations responsibilities for the agency, including negotiating wages, benefits, and working conditions.

4. Missouri: Proposed ‘Prohibit Abortion and Gender Transition Procedures for Minors Amendment’

Missouri’s Amendment 3, the “Prohibit Abortion and Gender Transition Procedures for Minors Amendment,” would repeal the “Right to Reproductive Freedom Initiative” approved by voters in 2024 and replace them with a more restrictive constitutional framework.

The proposal would allow abortion in specified circumstances, including certain medical emergencies, fetal anomalies, and rape or incest within designated limits. It would also prohibit certain gender-transition procedures for minors, subject to exceptions.

What it means for HR: Employers should monitor how any changes to healthcare access interact with employee benefits, medical travel policies, and applicable insurance rules. The amendment would not, by itself, determine every employer's health plan obligations.

5. Nevada: Proposed ‘Right to Abortion Initiative’

Nevada voters will consider Question 6, called the “Right to Abortion Initiative,” which is a proposed state constitutional amendment. The measure was approved by voters in 2024 and must receive a second approval in 2026 to become part of the state constitution.

What it means for HR: The measure could affect the broader legal environment surrounding healthcare access. Employers offering health benefits, particularly multistate organizations, should continue reviewing applicable insurance requirements and federal benefit-plan rules rather than assuming the amendment itself mandates changes to coverage.

6. Vermont: Expanding Collective Bargaining Rights

Vermont voters will consider Proposal 3, a constitutional amendment that would establish an explicit right for workers to organize and join labor organizations for collective bargaining purposes.

The proposal would also prohibit laws that interfere with collective bargaining rights, including measures restricting agreements requiring union membership or financial support as a condition of employment, subject to applicable federal law.

What it means for HR: The amendment could strengthen state-level protections for organizing and collective bargaining. Employers should monitor how the constitutional language interacts with federal labor law and whether implementing legislation or litigation clarifies its practical effect.

7. Vermont: Expanding Constitutional Equality Protections

Vermont’s Proposal 4 would amend the state constitution to expressly guarantee equal protection under the law regardless of race, ethnicity, sex, religion, disability, sexual orientation, gender identity, gender expression, or national origin.

The proposal also includes language allowing measures designed to promote equal treatment and opportunity for historically disadvantaged groups.

What it means for HR: The amendment could influence public-employment policies and future legal disputes involving government action and equal treatment. Private employers would still need to follow existing federal and state anti-discrimination laws, and the amendment would not automatically create a new private-sector employment statute.

8. Virginia: Proposed ‘Right to Reproductive Freedom Amendment’

Virginia voters will consider a proposed “Right to Reproductive Freedom Amendment,”, including provisions related to decisions about pregnancy.

What it means for HR: Employers with Virginia-based employees may want to review how the state’s legal environment interacts with healthcare benefits, leave policies, and employee assistance programs. Any resulting obligations would depend on the amendment's final interpretation and other applicable laws.

9. Wisconsin: Changing Constitutional Rules for Public Employment

Wisconsin voters will consider a constitutional amendment concerning equal treatment in public employment, public education, and public contracting.

The measure would prohibit government entities from discriminating against or granting preferential treatment to individuals or groups based on specified protected characteristics in those areas.

What it means for HR: Government employers would need to evaluate hiring, recruitment, promotion, and workplace inclusion and diversity practices against the amended constitutional requirements. The measure’s direct reach would be public-sector employment rather than private workplaces generally.
