5 Essential Skills for Modern Workplace Investigations

A workplace investigation is one of HR's most important mechanisms for addressing misconduct, resolving employee complaints, and maintaining trust. But workplace investigations today look very different than they did a decade ago. 

The misconduct that HR used to investigate happened in person and onsite. Today, investigators may be asked to examine behavior that has occurred online, across multiple time zones, or through digital collaboration platforms. Complaints can involve emails, chat messages, screenshots, recorded meetings, social media activity, and even content generated by artificial intelligence.

As a result, the workplace investigation process has become significantly more complex, according to Mika J. Cross, CEO of consulting firm Strategy@Work. Investigators must evaluate growing volumes of digital evidence while balancing concerns around privacy, confidentiality, and data integrity.

What Is a Workplace Investigation?

A workplace investigation is a structured process used to examine complaints involving misconduct, harassment, discrimination, retaliation, policy violations, or other workplace concerns. The goal is to gather facts, review evidence, and determine whether organizational policies or legal obligations have been violated.

Effective workplace investigations should be prompt, impartial, and well documented. They require a clear scope, a neutral investigator, and a consistent process for evaluating evidence and interviewing participants.

When conducted effectively, workplace investigations help organizations reduce risk, reinforce workplace standards, and strengthen employee trust.

Why Workplace Investigations Are More Complex Today

In an increasingly complex and digitized landscape, workplace investigations are difficult to get right, especially when using outdated processes. But they're crucial to building trust, upholding cultural values, and managing risk.

When they’re done right, investigations become an early warning system to surface behavioral patterns and expose cultural gaps. They can give you the opportunity to fix issues before they escalate.

Today’s employees experience unrelenting misconduct. Nearly 76% of U.S. workers indicated they have personally experienced or witnessed acts of incivility over the past month, according to SHRM's Q2 2026 Civility Index. Of those, more than half said the behavior they saw occurred in the workplace. 

Workplace investigations can help root out these behaviors. Intervention is key to reducing the fallout from incivility. To make an impact, however, investigators must be prepared to address the challenges posed by a workplace undergoing technological upheaval, nuanced interpersonal dynamics, and shifting employee expectations.

Consider, for example, how new technology like generative AI challenges investigators. HR must be able to spot AI-generated content, such as deepfake videos and AI-created images. But only 3% of respondents in a SHRM survey said they were extremely confident that their HR team could distinguish between an authentic video and an AI-generated video, according to SHRM’s January 2026 Current Event Toplines report. More troublingly, 40% said they have no plans to mitigate the risks associated with AI-generated videos in workplace investigations, according to the same report.

The increasing complexity of workplace investigations means success depends on more than simply following a checklist. Investigators must be able to evaluate evidence objectively, communicate effectively, protect confidentiality, and make fair decisions in situations where facts are often incomplete or disputed.

The Skills Behind Effective Investigations

To keep up with modern misconduct, employers need workplace investigations that bolster trust, reinforce culture, and minimize risk. Cross named five skills that will help Investigators achieve these goals and create effective investigations for the modern workplace.

1. Strong Judgment

Investigators aren’t just collecting a series of facts, they’re interpreting information to make nuanced decisions based on the evidence available to them. Today’s investigators must sort through piles of evidence, which makes context more important than ever. AI-powered tools can flag patterns in evidence, but investigators need to apply human judgment.

2. Interpersonal Communication

Investigators must offer strong communication skills. They need to build trust quickly, ask the right questions, and create a safe space that encourages employees to share difficult experiences. Virtual settings make this challenging, so investigators must be especially skilled in cultivating a sense of psychological safety.

3. Active Empathy

When people are involved in a workplace investigation, they may feel anxious, afraid, or even isolated. These feelings can be particularly strong in remote environments. Investigators must take a neutral but human-centered approach when interacting with participants. This empathy will help them obtain better information and achieve fairer outcomes. 

4. Technological Proficiency

Today's investigators need to understand both the technologies they use and the technologies employees use to do their work. HR must know how to navigate collaboration platforms, preserve digital evidence, and protect confidentiality in a distributed environment. As AI-generated content becomes more common, technological proficiency is becoming a foundational investigation skill rather than a specialized one.

5. Commitment to Consistency

Workplace investigations won’t succeed without consistency. Consistency makes an investigation defensible while promoting fairness among employees. Bringing consistency to workplace investigations means creating clear documentation, following defined steps, and carving out a repeatable process to reduce bias and increase credibility. 

​​Documentation and Confidentiality Matter

Strong workplace investigations depend on thorough documentation and appropriate confidentiality practices. Cross noted that an investigation is most defensible when it’s backed up by documentation. Investigators should carefully document interview notes, evidence, credibility assessments, and the reasoning behind their findings.

Confidentiality is also critical, though it is not absolute. Information should generally be shared only with people who have a legitimate need to know. This approach helps protect participants, preserve the integrity of the investigation, and maintain trust in the process.

Together, documentation and confidentiality help create investigations that are fair, consistent, and defensible.

Building Better Workplace Investigations

Today's workplace investigations require professionals who are equal parts analysts, communicators, and trusted problem-solvers.

“The best investigators know how to balance data with empathy, speed with fairness, and process with judgment,” Cross said. “That’s the new standard, and organizations that embrace it are the ones that people trust and want to be part of.”

As workplace misconduct, digital evidence, and employee expectations continue to evolve, organizations must ensure their investigators have the skills needed to conduct fair, consistent, and defensible workplace investigations. The right training can help HR professionals build the confidence and expertise required to navigate increasingly complex workplace issues.
