EEOC Chair Signals Scrutiny of Labor Unions Over Discrimination

October 14, 2026 | Rachel Zheliabovskii

Labor unions could face heightened federal scrutiny over their employment practices as Equal Employment Opportunity Commission (EEOC) Chair Andrea Lucas has signaled interest in expanding the agency’s discrimination enforcement efforts beyond traditional employers.

Lucas recently responded on social media site X (formerly Twitter) to an International Brotherhood of Electrical Workers (IBEW) apprentice who alleged that an instructor told students they belonged to the wrong minority group to qualify for available jobs. Lucas suggested the apprentice could have grounds for a federal discrimination claim, emphasizing that the EEOC has jurisdiction over labor unions and apprenticeship programs.

The exchange suggests a potential new enforcement direction for the agency under the Trump administration, particularly regarding union inclusion and diversity (I&D) initiatives and access to employment opportunities.

Event: BLUEPRINT for I&D

A Broader Shift in EEOC Priorities

Lucas, who has served as an EEOC commissioner since 2020, was appointed acting chair by President Donald Trump in January 2025 and formally designated chair in November 2025.

Under her leadership, the agency has increasingly prioritized allegations of discrimination against whiteand male workers, particularly those involving I&D programs.

The EEOC has pursued high-profile investigations involving companies such as Nike and Northwestern Mutual and filed a discrimination lawsuit against The New York Times over allegations that its hiring and promotion practices disadvantaged a white male employee.

Lucas has characterized these efforts as necessary to ensure that federal civil rights protections apply equally to all workers, regardless of their demographic background.

Why Labor Unions Could Be Next

Although the EEOC traditionally focuses much of its enforcement activity on employers, Title VII of the Civil Rights Act of 1964 also prohibits labor organizations from discriminating based on protected characteristics.

These protections extend to union membership, hiring referrals, apprenticeship admissions, collective bargaining representation, and grievance procedures.

Historically, union discrimination cases often involved racial barriers preventing Black workers from accessing apprenticeships and skilled trades. In 2020, for example, a Florida plumbing and pipefitting apprenticeship program agreed to pay $207,500 to settle EEOC allegations that it systematically denied opportunities to Black applicants.

The agency’s emerging approach could instead place greater emphasis on whether I&D programs unlawfully disadvantage other demographic groups.

However, former EEOC officials and labor law experts have questioned whether union discrimination warrants increased enforcement resources, while others warn that targeting I&D initiatives could undermine efforts to address long-standing inequalities.

What Employers and Unions Should Know

For employers working with unions, particularly in construction, manufacturing, and other apprenticeship-heavy industries, the development underscores the importance of reviewing recruitment and training practices.

Organizations should ensure that apprenticeship selection criteria, job referrals, and advancement opportunities comply with federal anti-discrimination requirements. I&D initiatives should also be evaluated to determine whether eligibility or employment decisions improperly depend on protected characteristics.

Importantly, Lucas’ comments do not establish a formal new enforcement initiative. Nevertheless, they suggest that unions and employers operating joint training programs could face additional scrutiny as the EEOC continues reshaping its enforcement priorities.

The broader message is clear: Federal discrimination enforcement may increasingly extend beyond employers to the labor organizations that influence workers’ access to jobs and career advancement.
