SHRM and CalSHRM Submit Comment on Proposed AI Regulations
On Nov. 18, SHRM and the California State Council of SHRM (CalSHRM) submitted their third written public comment to California Civil Rights Department Civil Rights Council (CCRC) about its Proposed Modifications to Employment Regulations Regarding Automated-Decision Systems.
“SHRM and CalSHRM are concerned that CCRC’s proposed regulations regarding automated decision-making systems, if implemented, may chill the adoption of AI by businesses and HR professionals in California and by out-of-state organizations that operate in California, preventing them from fully realizing AI’s potential,” the groups wrote.
“... We are concerned that CCRC’s proposed regulations, while well-intentioned, may hinder California businesses from achieving the myriad benefits of AI, including increased productivity, enhanced decision-making, and the creation of new high-skill job opportunities. Stifling the adoption of AI could also impede California businesses’ critical efforts to upskill and reskill their workforce, a process that is essential for both businesses and workers as the global economy continues to evolve.”
They added, “SHRM and CalSHRM urge CCRC to balance preventing algorithmic discrimination with enabling responsible AI use. SHRM and CalSHRM are in favor of regulations and guidelines that support, rather than stifle, workplace and workforce innovation. We believe the key is to implement a balanced approach that safeguards job candidates’ and employees’ rights while enabling businesses to use tools that will lead to better workforce decisions.”
