2026 Ballot Measure Results: What They Mean for HR

November 6, 2026 | Rachel Zheliabovskii

Man voting at a booth

Voters across several states weighed in on ballot initiatives with potential workplace implications during the Nov. 3 midterm elections. From collective bargaining rights and employment discrimination protections to reproductive healthcare and marijuana regulation, the results could influence how employers manage their workforces and handle legal compliance.

Voters approved measures expanding collective bargaining protections in Maryland, Massachusetts, and Vermont, while Wisconsin adopted new constitutional restrictions affecting public employment. Other states voted on reproductive healthcare protections that could have indirect implications for employee benefits.

Although some measures directly affect employment-related laws, others have broader consequences for healthcare access and workplace policies. Here’s how nine initiatives fared and what the results mean for HR professionals.

1. Idaho: Restricting Future Marijuana Legalization Initiatives

Result: Rejected

Idaho voters rejected HJR 4, a proposed constitutional amendment that would have given the state legislature exclusive authority to legalize marijuana, narcotics, and other psychoactive substances.

The amendment would have prevented voters from legalizing those substances through citizen-initiated statutes. Its defeat preserves the existing initiative process, allowing voters to pursue future legalization proposals.

What it means for HR: The result does not immediately change Idaho’s controlled-substance laws or employer drug-testing requirements. However, employers should continue monitoring future marijuana-related ballot initiatives that could affect workplace safety and substance-use policies.

2. Maryland: Funding State Employee Labor Agreements

Result: Approved

Maryland voters approved Question 1, the Arbitration Reform for State Employees Act of 2026, amending the state constitution to require the governor to include funding for collective bargaining agreements in the proposed state budget.

The requirement covers negotiated employment terms, including wages, hours, fringe benefits, and healthcare benefits, whether reached through negotiations or binding arbitration.

What it means for HR: The amendment strengthens the connection between collective bargaining agreements and state budget planning. Public-sector HR professionals should review how the new requirements affect compensation planning, contract negotiations, and implementation of employment agreements.

3. Massachusetts: Allowing Public Defenders to Unionize

Result: Approved

Massachusetts voters approved Question 2, granting collective bargaining rights to eligible employees of the Committee for Public Counsel Services (CPCS), the state’s public defender agency.

The measure allows employees to pursue union representation and negotiate employment contracts, addressing their previous exclusion from collective bargaining under state law.

However, employees will still need to complete the necessary union certification process before beginning collective bargaining.

What it means for HR: The measure creates a pathway for new labor relations responsibilities within the agency, including potential negotiations over wages, benefits, and working conditions. Its direct application is limited to the affected public-sector workforce.

4. Missouri: Proposed ‘Prohibit Abortion and Gender Transition Procedures for Minors Amendment’

Result: Rejected

Missouri voters rejected Amendment 3, the “Prohibit Abortion and Gender Transition Procedures for Minors Amendment,” which would have repealed the reproductive freedom protections approved by voters in 2024.

The proposal would have replaced those protections with a more restrictive constitutional framework, permitting abortion in certain circumstances involving medical emergencies, fetal anomalies, rape, or incest. It also would have prohibited certain gender-transition procedures for minors, subject to exceptions.

The rejection leaves the state’s existing constitutional reproductive freedom protections in place, although litigation and other applicable laws continue to shape healthcare access.

What it means for HR: Employers should continue reviewing how reproductive healthcare access interacts with employee benefits, medical travel policies, and insurance requirements. The result does not independently establish new employer-sponsored health coverage obligations.

5. Nevada: Proposed ‘Right to Abortion Initiative’

Result: Approved

Nevada voters approved Question 6, the “Right to Abortion Initiative,” for a second time, following its initial approval in 2024.

The amendment establishes a constitutional right to abortion before fetal viability and afterward when medically necessary to protect the pregnant patient’s life or health.

With voters approving the measure in two successive general elections, the protections can become part of the Nevada Constitution.

What it means for HR: The amendment strengthens the state’s constitutional protections for reproductive healthcare access. Employers offering health benefits, particularly multistate organizations, should continue reviewing applicable insurance requirements and federal benefit-plan rules. The amendment does not automatically mandate specific employer-sponsored coverage.

6. Vermont: Expanding Collective Bargaining Rights

Result: Approved

Vermont voters approved Proposal 3, establishing an explicit constitutional right for workers to organize and join labor organizations for collective bargaining purposes.

The amendment also prohibits state laws that interfere with collective bargaining rights, including certain restrictions on union membership or financial support arrangements, subject to applicable federal law.

What it means for HR: The amendment strengthens state-level protections for organized labor. Employers should monitor how the new constitutional language interacts with federal labor law and whether future legislation or court decisions clarify its practical application.

7. Vermont: Expanding Constitutional Equality Protections

Result: Approved

Vermont voters also approved Proposal 4, amending the state constitution to expressly guarantee equal protection under the law regardless of race, ethnicity, sex, religion, disability, sexual orientation, gender identity, gender expression, or national origin.

The amendment expands the state’s constitutional equality protections and includes provisions allowing measures intended to promote equal treatment and opportunity for historically disadvantaged groups.

What it means for HR: The amendment could influence public-employment policies and future litigation involving government action and equal treatment. Private employers must continue complying with existing state and federal anti-discrimination laws, although the amendment does not automatically create new private-sector employment requirements.

8. Virginia: Proposed ‘Right to Reproductive Freedom Amendment’

Result: Approved

Virginia voters approved Question 1, the “Right to Reproductive Freedom Amendment,” establishing constitutional protections for decisions involving pregnancy and reproductive healthcare.

The amendment protects abortion before the third trimester and in specified circumstances afterward, including when necessary to protect the pregnant patient’s life or health. It also addresses other aspects of reproductive healthcare, including contraception and fertility care.

What it means for HR: Employers with Virginia-based employees should monitor how the state’s constitutional protections interact with healthcare benefits, leave policies, and employee assistance programs. Any specific employer obligations will continue to depend on applicable state and federal laws.

9. Wisconsin: Changing Constitutional Rules for Public Employment

Result: Approved

Wisconsin voters approved Question 3, a constitutional amendment prohibiting government entities from discriminating against or granting preferential treatment based on race, sex, color, ethnicity, or national origin in public employment, public education, public contracting, and public administration.

The amendment establishes new constitutional restrictions on how government employers and other public entities may consider those characteristics in decision-making.

What it means for HR: Public-sector employers should review hiring, recruitment, promotion, and workplace diversity and inclusion practices to ensure compliance with the new requirements. The amendment directly applies to governmental entities rather than private employers generally.

What Employers Should Watch Next

Although the election has concluded, the workplace implications of several approved measures may take time to become clear.

Some constitutional amendments may require additional legislation, agency guidance, or judicial interpretation to establish their full practical effects. Employers should monitor effective dates, assess whether new requirements apply to their organizations, and review existing policies where necessary.

For multistate employers, the results underscore the importance of tracking state-level legal developments, particularly in labor relations, public employment, and employee benefits.
