ALEXANDRIA, Va. – Emily M. Dickens, SHRM Chief Administrative Officer, issued the following statement in response to the rescission of EEO-reporting forms:
SHRM supports rescinding the current federal EEO reporting requirements only if they are replaced with a more modern, accurate, and useful framework that better supports compliance, effective enforcement of equal employment opportunity laws, and informed workforce decision-making. Federal and state governments have a fundamental responsibility to enforce our nation's equal employment opportunity laws, and workforce demographic data remains an important tool in advancing that responsibility.
To be effective, however, reporting requirements must produce data that is reliable, meaningful, and actionable. Frameworks that generate incomplete, overly broad, or outdated information provide limited value for employers, regulators, and employees while creating unnecessary administrative burdens. Importantly, rescinding the current reporting framework would not alter employers' obligations under Title VII. Employers remain responsible for maintaining appropriate employment records and making nondiscriminatory employment decisions, regardless of how workforce data is reported.
SHRM encourages the EEOC to use this opportunity to modernize EEO reporting by developing a replacement framework that improves data quality, reflects today's workforce, reduces unnecessary burdens, and provides employers and enforcement agencies with more meaningful information. SHRM stands ready to work with policymakers throughout the rulemaking process and will continue providing employers with practical guidance that supports lawful, data-informed workplace practices.
