The EEO-1 Component 1 Report is a mandatory annual data collection submitted to the U.S. Equal Employment Opportunity Commission (EEOC). It requires certain employers to report workforce demographic data by race/ethnicity, sex, and job category. The purpose is to support the enforcement of federal equal employment opportunity (EEO) laws and help identify employment patterns.
Who Is Required to File?
The following employers must file an EEO-1 Component 1 Report annually:
- Private employers with 100 or more employees
- Federal contractors (and first-tier subcontractors) with 50 or more employees and a federal contract, subcontract, or purchase order worth $50,000 or more
- Multi-establishment employers (with more than one physical location) must submit additional reports for each location
What Information Must Be Reported?
Employers must report employee data as of a “workforce snapshot period” (a pay period between October 1 and December 31 of the reporting year), including:
- Number of employees by race/ethnicity
- Number of employees by sex
- Number of employees by job category (e.g., Executive/Senior Level Officials, Professionals, Technicians, etc.)
Key Dates & Deadlines
The filing period generally opens in the spring of the following year (e.g., 2024 data due in 2025). Deadlines and updates are posted on the EEOC’s EEO-1 website.

- Use self-identification forms during onboarding to collect race/ethnicity and gender data.

According to recent administrative documents filed by the Equal Employment Opportunity Commission (EEOC), this year’s collection of EEO-1 reports will begin in less than a month – and will not allow employers to categorize workers as “non-binary.” Private employers with at least 100 employees and federal contractors with at least 50 employees should prepare to sort company data by employee job category, as well as by sex and race/ethnicity, to turn over to the EEOC between May 20 and June 24. While these dates are not yet set in stone, they provide a glimpse into how we can expect this year’s EEO-1 reporting season to go.

Employers will continue to be required to provide the EEOC with data about the size, location, race or ethnicity, and gender demographics of their workforce. The 2024 report, like prior reports, will be based on a workforce payroll snapshot taken during the fourth quarter of the prior year. For this year, the snapshot should be a payroll period from October 1, 2024 to December 31, 2024.

Shortened Reporting Period
The proposed 2024 Instruction Booklet provides for a shortened reporting period—down to five weeks—from the platform opening date of May 20, 2025, to the filing deadline of June 24, 2025.
Changes to Reporting by Sex
The proposed 2024 Instruction Booklet eliminates the option to report non-binary employees, stating that the reporting provides “only binary options (i.e., male or female) for reporting employee counts.” This change is tied to Executive Order 14168, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.”

The updated instruction booklet includes a new “Failure to File” section, which provides that if an employer does not file by this year’s June 4, 2024 deadline they will receive a failure to file notice from the EEOC. The notice will inform employers that they are out of compliance and alert them to file by July 9, 2024. No additional EEO-1 Component Reports will be accepted after the July 9, 2024 deadline.
