Colorado Adds Reasons for Sick Leave Usage (8/7/23)




​On June 2, 2023, Governor Jared Polis signed into law Senate Bill (SB) 23-017, which expands the qualifying reasons an employee may take leave under the Colorado Healthy Families and Workplaces Act (HFWA).

The amendments take effect on August 7, 2023. As of this date, Colorado employers will be required to allow eligible employees to use available paid sick leave under the HFWA for several new covered reasons.

Colorado employers must also notify employees of their right to take paid leave under the HFWA, including the reasons for which employees can take such leave. For that reason, Colorado employers should consider updating their sick leave policies to set forth the new grounds for which employees may take leave and to update their sick leave poster on or before the effective date of the new law. Colorado is expected to publish an updated poster regarding these changes to the HFWA in the coming months.
Colorado Expands Reasons Employees Can Use Paid Sick Leave

In addition to the reasons already in effect since HFWA first passed three years ago, employers must also now allow employees to use accrued paid sick leave to: (1) grieve, attend funerals or memorial services, or deal with financial and legal matters related to the death of a family member; (2) care for a family member whose school or place of care has been closed because of inclement weather, loss of power, heating, or water, or another unexpected occurrence or event; or (3) evacuate their residence because of inclement weather, loss of power, heating, or water, or another unexpected occurrence or event.
