In California, is make-up time allowed without incurring overtime when that time takes an employee beyond eight hours of work in a day?




Yes, make-up time can be worked without incurring overtime when it is approved within the limitations of the law. Several wage orders specifically allow for this, as detailed in Section 3, Hours and Days of Work of each order.

In general, California employees must request make-up time in writing. Make-up time can be requested to make up work hours the employee has lost or will lose as a result of a personal obligation. The make-up time hours must be performed within the same workweek in which the time was lost and cannot result in more than 11 hours worked in one day or more than 40 hours in one workweek.
