Additionally, on September 24, 2025, the U.S. Department of Homeland Security issued a proposed rule to change the H-1B lottery system. This notice of proposed rulemaking would move the lottery away from a purely random system toward one that weights selections by wage level. Under the proposal, workers at the highest wage levels would have the greatest probability of selection, while those at lower wage levels would see significantly reduced chances.
